Terms of Service

These Terms of Service ("Terms") govern use of Urban Farming SA at https://urbanfarmingsa.co.za (the "Platform"). By creating an account, listing products, browsing, or placing an order, you agree to these Terms. If you do not agree, do not use the Platform.

These Terms are written for a South African marketplace. They do not replace advice from your own attorney. Nothing here limits rights that cannot be limited under the Consumer Protection Act 68 of 2008 (CPA) or other mandatory law.

2. Eligibility

You must be at least 18 years old (or a legally emancipated minor) and able to form a binding contract under South African law. Farmers must provide accurate identity, contact, collection, and payout information and keep it updated.

3. Marketplace role

Urban Farming SA operates an online marketplace connecting buyers with registered urban farmers. Unless we expressly sell an item ourselves (for example platform e-books), we are not the grower or supplier of produce listed by farmers. Farmers are responsible for:

• Accuracy of product descriptions, pricing, stock, and photos
• Food safety, hygiene, and lawful growing / handling practices
• Honest chemical-use and organic claims
• Honouring published collection times and locations

4. Accounts and acceptable use

You are responsible for keeping login credentials confidential and for activity under your account. You may not abuse the Platform, circumvent fees or security controls, scrape personal data, harass users, or list illegal, unsafe, or misrepresented goods. We may suspend or terminate access for breach, fraud risk, or legal compliance.

5. Collection-only fulfilment (produce)

Produce orders are collection-only unless we expressly state otherwise. Buyers must collect from the farmer's published collection point during the stated windows and present any collection PIN or order reference. Failure to collect within a reasonable time after the order is marked ready may result in cancellation without refund where the goods have deteriorated or been set aside for you, subject to the CPA.

6. Fees and farmer payouts

Buyers pay the listed price in South African Rand (ZAR). For produce sales, Urban Farming SA retains 10% as a platform fee; farmers receive 90% via weekly payout (EFT or Capitec Send Cash), after successful payment verification and subject to chargebacks, refunds, or fraud holds. Digital e-book sales are retained by the platform unless otherwise stated.

7. Payments, pricing, and VAT

Payments are processed through PayFast into the Urban Farming SA merchant account. Card and sensitive payment data are handled by PayFast, not stored in full on our servers.

Unless a VAT number is published above, prices are charged as displayed. Tax invoices will be issued in the form required once VAT registration details (if any) are confirmed.

8. Cancellations, refunds, and the CPA

• Unpaid or abandoned checkouts may be cancelled automatically. If a paid produce order cannot be fulfilled (for example stock failure before collection), we will refund the original payment method where reasonably possible.
• Produce is perishable and prepared for collection. After a farmer marks an order ready or completed, refunds are limited to quality or fulfilment failures reported promptly on collection, unless the CPA requires otherwise.
• Digital e-books: once a download link has been issued and used, refunds are generally not available, except where the file is defective or where the CPA / Electronic Communications and Transactions Act 25 of 2002 (ECT Act) requires a refund. If a cooling-off right applies and has not been lawfully excluded for digital content that began performance with your consent, we will honour that right.
• Nothing in these Terms excludes rights under the CPA that cannot be excluded by agreement.

9. Electronic communications (ECT Act)

By using the Platform you consent to receive transactional electronic communications related to your account and orders (including email and WhatsApp notices). Marketing messages, if any, will be sent only where permitted by law and with an opt-out where required.

10. Intellectual property

Platform branding, site design, and platform-published e-book content belong to Urban Farming SA or its licensors. Farmers retain rights in their own photos and descriptions but grant us a licence to display them to operate the marketplace. You may not copy e-books for resale or public redistribution.

11. Liability

To the fullest extent permitted by South African law, Urban Farming SA is not liable for produce quality disputes between buyers and farmers, farmer scheduling failures outside our reasonable control, or indirect or consequential losses. Our aggregate liability arising from any single order is limited to the amount paid for that order, except where liability cannot be limited (including for gross negligence or as the CPA requires).

Personal information is processed under our Privacy Policy and POPIA statement.

13. Complaints and disputes

Contact us first at info@urbanfarmingsa.co.za or via the contact form so we can try to resolve the issue. You may also have rights to approach the National Consumer Commission, a consumer court / tribunal, or a competent South African court, and for privacy matters the Information Regulator.

14. Governing law

These Terms are governed by the laws of the Republic of South Africa. Subject to mandatory consumer protections, the courts of South Africa have jurisdiction.

15. Changes

We may update these Terms by posting a revised version on the Platform with an updated "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms, except where acceptance must be obtained in another form by law.
