These Terms of Service ("Terms") govern use of Urban Farming SA at https://urbanfarmingsa.co.za (the "Platform"). By creating an account, listing products, browsing, or placing an order, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms are written for a South African marketplace. They do not replace advice from your own attorney. Nothing here limits rights that cannot be limited under the Consumer Protection Act 68 of 2008 (CPA) or other mandatory law.
You must be at least 18 years old (or a legally emancipated minor) and able to form a binding contract under South African law. Farmers must provide accurate identity, contact, collection, and payout information and keep it updated.
Urban Farming SA operates an online marketplace connecting buyers with registered urban farmers. Unless we expressly sell an item ourselves (for example platform e-books), we are not the grower or supplier of produce listed by farmers. Farmers are responsible for:
You are responsible for keeping login credentials confidential and for activity under your account. You may not abuse the Platform, circumvent fees or security controls, scrape personal data, harass users, or list illegal, unsafe, or misrepresented goods. We may suspend or terminate access for breach, fraud risk, or legal compliance.
Produce orders are collection-only unless we expressly state otherwise. Buyers must collect from the farmer's published collection point during the stated windows and present any collection PIN or order reference. Failure to collect within a reasonable time after the order is marked ready may result in cancellation without refund where the goods have deteriorated or been set aside for you, subject to the CPA.
Buyers pay the listed price in South African Rand (ZAR). For produce sales, Urban Farming SA retains 10% as a platform fee; farmers receive 90% via weekly payout (EFT or Capitec Send Cash), after successful payment verification and subject to chargebacks, refunds, or fraud holds. Digital e-book sales are retained by the platform unless otherwise stated.
Payments are processed through PayFast into the Urban Farming SA merchant account. Card and sensitive payment data are handled by PayFast, not stored in full on our servers.
Unless a VAT number is published above, prices are charged as displayed. Tax invoices will be issued in the form required once VAT registration details (if any) are confirmed.
By using the Platform you consent to receive transactional electronic communications related to your account and orders (including email and WhatsApp notices). Marketing messages, if any, will be sent only where permitted by law and with an opt-out where required.
Information about us for electronic transactions is set out in these Terms, our Privacy Policy, and on the Platform (including pricing, collection terms, and contact details).
Platform branding, site design, and platform-published e-book content belong to Urban Farming SA or its licensors. Farmers retain rights in their own photos and descriptions but grant us a licence to display them to operate the marketplace. You may not copy e-books for resale or public redistribution.
To the fullest extent permitted by South African law, Urban Farming SA is not liable for produce quality disputes between buyers and farmers, farmer scheduling failures outside our reasonable control, or indirect or consequential losses. Our aggregate liability arising from any single order is limited to the amount paid for that order, except where liability cannot be limited (including for gross negligence or as the CPA requires).

Contact us first at info@urbanfarmingsa.co.za or via the contact form so we can try to resolve the issue. You may also have rights to approach the National Consumer Commission, a consumer court / tribunal, or a competent South African court, and for privacy matters the Information Regulator.
These Terms are governed by the laws of the Republic of South Africa. Subject to mandatory consumer protections, the courts of South Africa have jurisdiction.
We may update these Terms by posting a revised version on the Platform with an updated "Last updated" date. Continued use after changes constitutes acceptance of the revised Terms, except where acceptance must be obtained in another form by law.
